Fideicomiso Trust:

Foreigners can purchase homes in Mexico through a Fideicomiso or "Trust"

The Mexican Constitution issued in 1917 regulates everything concerning Mexican Territory. It also established a "restricted area." The restricted area prevents foreigners from "direct" ownership of property within that area. The restricted area encompasses 100 kilometers along the border and 50 kilometers along the coast. Foreigners are allowed to purchase property in an "indirect way." The most common of these ways is the Fideicomiso Trust.

As a foreigner, due to the North American Free Trade Agreement of 1994 and the Foreign Investment Act of 1993, you are allowed to own 100% of the shares of a corporation and purchase property. You can acquire irrevocable and absolute ownership rights to property in Mexico through a 50 year perpetually irrevocable and transferable Fideicomiso Trust that may be renewed for an additional 50 years. This allows foreigners, as beneficiaries of the trust to enjoy unrestricted use of land located in the restricted areas.

With the trust, you may lease, improve, mortgage, sell, profit, will and inherit the property.
